The Agreement or Engagement of those who intended to remove fromConnecticut to Massachusetts, is dated at Hartford, April 18, 1659, andis recorded on the first book of Hadley records. The following is a copyof that Agreement and of some proceedings of a later date recorded withthe other:

"At a meeting at Goodman Ward's house, in Hartford, April 18th, 1659, thecompany there met engaged themselves under their own hands, or by theirdeputies, whom they had chosen, to remove themselves and their familiesout of the jurisdiction of Connecticut into the jurisdiction of theMassachusetts, as may appear in a paper dated the day and year abovesaid.The names of the engagers are these:--

1st. We whose names are above written do engage ourselves mutually one toanother, that we will if God permit, transplant ourselves and families tothe plantation purchased, on the east side of the river of Connecticut,beside Northampton, therein to inhabit and dwell by the 29th of Septembercome twelve months, which will be in the year 1660. [Meaning Sept. 29th,1660.]

2d. That each of us shall pay the charges of the land purchased accordingto his proportion, as also for the purchase of Hockanum.

3d. That we will raise all common charges, of what sort soever, for thepresent, upon the land that men take up: mow, plow land and house lot,according to the proportion of land that each man takes of all sorts; andall charges shall be paid as they shall arise and be due, from the datehereof.

4th. That if any persons so engaging be not inhabiting there by the timeaforesaid, then, notwithstanding their payment of charges, their landsand what is laid out in rates shall return to the town: and yet thisarticle doth not free men from their promise of going and inhabiting.

5th. That no man shall have liberty to sell any of his land till he shallinhabit and dwell in the town three years; and also to sell it to noperson, but such as the town shall approve on.

Agreed that all those persons that will go up within three weeks shallgive in their names by this day fortnight, and then those that are soagreed shall take up a quarter together, and so those that follow shalltake up another quarter, so they do it together, or so far as theirnumbers run.

Agreed also that no persons shall fell any trees upon any lot of groundlotted out, or to be lotted out, but upon his own ground or lot, oragainst his own lot within ten rods of the same in the highway. The landto be lotted is either what is for the homelots, or between the homelotsand the meadow.

It is agreed also by the said company, upon the 25th of April 1659, thatthey will purchase the lands on the west side of the great river, aboveNapanset, if it can be bought, and that each of the said engagers willpay their several proportions to the said purchase, according to whatthey have put in to take up lands by, at the time of their saidengagement: witness their hands, dated April the 18th 1659.

At the said meeting William Westwood, Richard Goodman, William Lewis,John White and Nathaniel Dickinson were chosen by the whole company, togo up to the foresaid plantation, on the east side of Northampton, and tolay out the number 59 homelots, and to allow eight acres for everyhomelot, and to leave a street 20 rods broad betwixt the two westermostrows of homelots; and to divide the said rows of homelots into quartersby highways. Those men, being willing to answer the desire of the saidcompany, did undertake the work. They desiring to make some beginningthere for themselves, the company granted them liberty, according to aformer agreement, that they might choose in any of the quarters to layout their own homelots, provided they took them together at one side ofany of the said quarters.

The plantation being begun by them and some other of the engagers, therest of the engagers that remained at Hartford and Wethersfield, withthose that were come up to inhabit at the said plantation, did upon theninth of November (1659) at Hartford, and about the said time atWethersfield, and at the said plantation, choose by vote, WilliamWestwood, Nathaniel Dickinson, Samuel Smith, Thomas Standley, John White,Richard Goodman, and Nathaniel Ward, to order all public occasions, thatconcern the good of that plantation for the year ensuing.

The said Townsmen made a rate upon the 22d of November, 1659, for thepaying of the purchase of the said plantation, and for the minister'smaintenance, levying it at 50 shillings the 100 pounds, which in thewhole sum came to 180 pounds; for the speedy gathering of this rate, wesent the rate down to the two towns Hartford and Wethersfield, that thecharges might be truly paid and satisfied, by every man according to hisengagement, as is visible in the engagement itself, that is dated the18th of April 1659.

There are 59 names to the Agreement, and one not fully engaged. Of these,-'II first named, from John Webster to Andrew Warner, inclusive, belongedto Hartford, except Samuel Porter, who was from Windsor, but may haveresided in Hartford in 1659. The next 20, from Mr. John Russell, Jr. toJohn Latimer, inclusive, belonged to Wethersfield; the next two, PeterTilton and John Hawks, were of Windsor, and 5 or 6 of the 7 below Hawks,were of Hartford. Those with this mark, * 18 in number, did not remove toHadley, or remained there but a short time.

BIOGRAPHY FROM THE HAWKES FAMILY GENEALOGY

John Hawks came to Dorchester, MA, 1630 in Winthrop's fleet and thenmoved to Windsor, CT, in 1640 as one of the founders. Ecclesiasticalorthodoxy led him, along with his wife Elizabeth Browne, to move toHadley, MA, in 1659 again as one of the founders. Adam Hawkes of Sauguswas apparently a brother and the two came to New England together. JohnHawks/Hawkes was born in England and died 30 Jun 1662 in Hadley, MA.

John's wife, Elizabeth Browne, was a niece of Nathaniel Ward, an originalsettler of Hartford, CT. Nathaniel Ward was the son of Edward Ward ofLittle Wrathing, Suffolk Co., England. On 9 Jan 1620, Edward made hiswill, proved at Ipswich 7 Mar 1620. He provided for his wife Judith andhis children Nathaniel, Edward, Lydia, Mary, Rebecca and Susan.

Susan Browne, widow of Robert Browne of Ipswich, made her will 22 Mar1626, proved 24 April 1627. She remembered her mother Judith and both ofher sisters, Rebecca Ward and Mary Cutting, as well as "Elizabeth Browne,daughter of my borther-in-aw William Browne." As Lydia Ward was thefourth sister, it was she who married William Browne and their daughterElizabeth was the niece of Nathaniel Ward (of Hartford). Elizabeth Brownemarried John Hawks in about 1642.

John & Elizabeth's children were all born in Windsor. At a meeting heldat Nathaniel Ward's house in Hartford, 18 Apr 1659, John was among thosepresent who signed the agreement to remove from Connecticut toMassachusetts. They moved to Hadley, MA, around 1660. John died suddenlyand was buried 30 June 1662 in the Hadley Cemetery. Elizabeth marriedRobert Hinsdale as his second wife about 1668.

The marriage was an unhappy one and they soon parted, and she returned toher home in Hadley. At a court held 30 Mar 1674 they were "presented forliving assunder contrary to law," also charged "with lacivious and wantoncarrage." On examination Elizabeth refused to answer, and it appears thatshe was cleared of any wrongdoing. Robert Hinsdale said he "did it asbeing her head and having the rule of her in the pointe and that he didit for her correction of her disorder towards him." Although he was arespected man in the community, the court held he had "broken the perfectrule of divine law and the law of the Colony in the intent if not in theletter in the first livinig assunder," and ordered him "whipped tenstripes on the naked body;" and imposed a fine for which his sons becameresponsible and which the court refused to remit after his tragic death.They moved to Pocumtuck (Deerfield), MA, where descendents of both werealready living. Robert was killed, along with three of his sons, withCaptain Thomas Lathrop, on 18 September 1675 in the ambush at BloodyBrook, MA.

I, A B, etc., being, by the Almighty’s most wise disposition, become amember of this body, consisting of the Governor, Deputy Governor,Assistants and a commonalty of the Massachusets in New England do freelyand sincerely acknowledge that I am justly and lawfully subject to thegovernment of the same, and do accordingly submit my person and estate tobe protected, ordered and governed by the laws and constitutions thereofand do faithfully promise to be from time to time obedient andconformable thereunto, and to the authority of the
said Governor and Assistants and their successors, and to all such laws,orders, sentences, and decrees as shall be lawfully made and published bythem or their successors; and I will always endeavor (as in duty I ambound) to advance the peace and welfare of this body or commonwealth tomy utmost skill and ability; and I will to my best power and means, seekto divert and prevent whatsoever may tend to the ruin or damage thereofor of any the said Governor, Deputy Governor, or Assistants, or any ofthem or their successors, and will give speedy notice to them, or some ofthem, of any sedition, violence, treachery, or other hurt or evil which Ishall know, hear, or vehemently suspect to be plotted or intended againstthe said commonwealth, or the said government established; and I will notat any time suffer or give consent to any counsel or attempt that shallbe done, given, or attempted for the impeachment of the said government,or making any change alteration of the same, contrary to the laws andordinances thereof but shall do my utmost endeavor to discover, oppose,and
hinder all and every such counsel and attempt. So help me God.
